2. Service Description

Exicity is an outdoor escape game where users purchase quest-based games. After purchase, players receive a unique code via email to access the selected game. These games are self-guided and require players to visit real-world city locations and solve puzzles inspired by physical landmarks (e.g., buildings, patterns, statues). Authentication is optional; however, without an account, game progress will not be saved.

2.1 Age Restrictions and Supervision

Exicity games are primarily recommended for participants aged 18 and over, as quests take place in urban public areas and players must navigate independently. Players aged 14 to 17 may only participate under the supervision of an adult (18+). Children under 14 may only play with parental or legal guardian accompaniment. The games do not contain dangerous tasks or locations; however, due to the open urban environment, participants must act carefully and responsibly.

3. Data Privacy

4. Account Usage

Creating an account is optional. If you choose to register, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

5. Purchases and Payments

All purchases are processed via trusted third-party payment providers. Exicity does not store or handle any credit card or banking data. After payment, a non-transferable access code is delivered by email. Refunds are not provided unless explicitly stated. Codes are for personal, non-commercial use only.

5.1 Ticket Activation and Duration

The game begins when participants click the "Open Your Game" button received in the email, then enter their team name and press the "Start Game" button. From this moment, the quest becomes active and a 72-hour countdown begins for completing the game. This extended timeframe allows you to complete the game on another day as well, in case a location is temporarily inaccessible due to events or other circumstances. If the website is closed during gameplay, participants can return to the game at any time by clicking the "Open Your Game" button in the email, with their progress automatically saved. However, returning is only possible within the 72-hour time frame.

5.2 Refund Policy

Tickets are valid for 12 months from the date of purchase. Customers may request a refund within 14 days of purchase, as long as the ticket has not been used and the game has not been started. Once the game is started, the ticket is considered used and is no longer refundable. After 14 days from purchase, tickets are non-refundable, but they remain valid until the end of the 12-month validity period.

6. Intellectual Property

All content on the Exicity website — including but not limited to text, visuals, design elements, code, photos, and graphics — is the intellectual property of Exicity or its partners and is protected by copyright and trademark laws. You may not copy, reuse, publish, or distribute any content without prior written consent from Exicity.

7. User Conduct

Any violation of these conduct requirements may lead to suspension or permanent denial of access to our services.

8. User Photos

By uploading a team photo, participants agree that Exicity may publish and use such photos for the company's commercial purposes. Consent can be withdrawn at any time by contacting exicitygames@gmail.com. In such case, Exicity will stop any further use and remove the photo from public platforms within a reasonable time. Participants confirm that all persons shown in the uploaded photo have consented to the upload and to the use described above.

9. Liability Disclaimer

Exicity assumes no liability for any property or personal damage, injuries, or accidents suffered by participants during the game. Players participate at their own risk. Each participant must arrange for their own appropriate insurance. When using public spaces, participants are required to comply with local rules and regulations. Exicity is not liable for the acts or omissions of third parties. Furthermore, Exicity assumes no responsibility for game interruptions or unavailability due to circumstances beyond its control, such as extreme weather, public area closures, lack of internet connectivity, or unavoidable technical failures. Exicity also is not responsible if the game is interrupted because the participant's device (smartphone, which requires internet connection and sufficient battery charge for the entire gameplay) runs out of battery, malfunctions, or does not have adequate internet connectivity. Participation in the game while heavily intoxicated is not permitted. Exicity assumes no liability for any accidents or damages resulting from alcohol consumption or inappropriate behavior.

10. Limited Liability

Exicity does not guarantee that the game will function error-free or meet all expectations for every participant. The service is provided 'as is' without additional warranty. Exicity's liability – in case of any damage, loss, or claim – shall be limited to the amount of the purchased ticket price.

11. Modification of Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with the revised date. Continued use of the website or services after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without prejudice to mandatory consumer protections that apply in the user's country of residence.
